Terms of Use

These Terms of Use govern your access to and use of Agefully, including the website, mobile application, content, features, subscriptions, AI-powered tools, and related services.

By downloading, accessing, or using Agefully, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Agefully.

If you use Agefully on behalf of another person or organization, you represent that you have authority to bind them to these Terms.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use Agefully unless a parent or legal guardian accepts these Terms and supervises your use.

You may not use Agefully if you are prohibited from doing so under applicable law or if we previously suspended or terminated your access.

Agefully provides wellness, nutrition, movement, sleep, skin, mindfulness, habit, and healthy-aging planning tools for general informational purposes only.

Agefully is not a medical device, healthcare provider, clinical decision support tool, emergency service, dietitian, trainer, therapist, or substitute for professional advice. Agefully does not diagnose, treat, cure, prevent, monitor, or predict any disease or medical condition.

Always consult a qualified healthcare professional before making medical, nutrition, exercise, supplement, sleep, skin-care, medication, or lifestyle decisions, especially if you have a medical condition, are pregnant, have an injury, take medication, or experience concerning symptoms.

Do not ignore, delay, or avoid professional medical advice because of anything shown in Agefully. If you may have a medical emergency, call emergency services immediately.

Agefully may use AI systems to estimate meal nutrition, structure recipes, estimate visual age, generate future-self images, summarize signals, or provide coaching-style suggestions.

AI outputs are probabilistic estimates and may be wrong, incomplete, inconsistent, biased, or unsuitable for your circumstances. Food photos, labels, recipes, serving sizes, workouts, body inputs, Apple Health data, and third-party datasets can all contain errors.

You are responsible for reviewing, editing, and verifying AI outputs before using them. You must not rely on Agefully for medical, safety-critical, legal, financial, insurance, employment, or high-risk decisions.

You are responsible for the accuracy, legality, and appropriateness of information and content you submit, including meal photos, selfies, recipe text, recipe links, body inputs, logs, goals, preferences, and support messages.

You agree not to submit content that is unlawful, infringing, deceptive, harmful, abusive, exploitative, sexually explicit involving minors, privacy-invasive, malware-related, or otherwise violates these Terms or applicable law.

You agree not to reverse engineer, scrape, overload, bypass rate limits, share API keys, exploit subscriptions, interfere with security, use automated abuse, or use Agefully in a way that harms us, users, service providers, or third parties.

You are responsible for your device, internet connection, app store account, backups, credentials, and any costs charged by your carrier, platform, or app store.

Agefully may offer access through local app state, app store subscriptions, invitation codes, platform accounts, or other mechanisms. We may change, suspend, limit, or discontinue access methods at any time where permitted by law.

You must keep any account credentials, app store account, access codes, and devices secure. You are responsible for activity associated with your access unless caused by our willful misconduct.

We may suspend or terminate access if we believe you violated these Terms, created risk, abused AI or subscription systems, submitted unlawful content, threatened security, or used Agefully in a way that may expose us or others to liability.

Paid features may be offered through auto-renewing subscriptions, one-time purchases, trials, promotions, or other paid plans. Prices, features, trials, and availability may change where permitted by law.

iOS purchases are processed by Apple. Subscription management, billing, cancellation, refunds, and renewal controls are handled through your Apple account and App Store settings, subject to Apple's terms.

RevenueCat may help manage subscription status and entitlements. Access to paid features may depend on app store records, RevenueCat records, device state, network availability, and successful entitlement validation.

Unless required by law or app store rules, fees are non-refundable, partial periods are not credited, and failure to cancel before renewal may result in charges.

Promotional access, free access codes, trials, or grandfathered access may be changed, revoked, limited, or discontinued at any time unless prohibited by law.

You retain ownership of content you submit to Agefully. You grant Agefully a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, modify, create derivative outputs from, and otherwise use your content as necessary to provide, maintain, secure, improve, and support Agefully.

You represent that you have all rights and permissions needed to submit your content and grant this license. Do not upload someone else's face, private information, copyrighted content, paywalled content, or confidential content unless you have permission and lawful authority.

We may remove, refuse, limit, or disable content or features if we believe doing so is necessary to comply with law, enforce these Terms, protect users, protect providers, prevent abuse, or reduce risk.

Agefully may integrate or rely on third-party services, including Apple, Apple Health, Apple App Store, RevenueCat, Anthropic, OpenAI, Open Food Facts, Expo, hosting providers, and other infrastructure or support providers.

Third-party services are governed by their own terms, policies, licenses, data practices, pricing, availability, and restrictions. We do not control and are not responsible for third-party services, datasets, model outputs, outages, errors, or policy changes.

Open Food Facts product information, images, ingredients, and nutrition data may be user-contributed, incomplete, inaccurate, outdated, or licensed under third-party terms. You must verify food, allergen, and nutrition information independently.

Agefully only receives Apple Health, camera, photo library, notification, or other device data if you grant permission through your device or platform settings.

You can revoke permissions at any time. Some features may stop working or become less accurate if permissions are removed.

Agefully does not promise that Apple Health data, imported device data, or connected-source data will be available, accurate, complete, current, or uninterrupted.

Agefully, including its software, designs, text, graphics, logos, trademarks, trade dress, content, features, compilations, and other materials, is owned by Agefully or its licensors and is protected by intellectual property and other laws.

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use Agefully for your own lawful personal use.

You may not copy, modify, distribute, sell, lease, sublicense, publicly display, publicly perform, reverse engineer, decompile, or create competing products from Agefully except where law gives you a non-waivable right.

If you downloaded Agefully from Apple's App Store, Apple is not a party to these Terms and is not responsible for Agefully or its content.

Apple has no obligation to provide maintenance or support for Agefully. To the extent any warranty applies and is not effectively disclaimed, you may notify Apple and Apple may refund the purchase price, if any, according to App Store rules.

Apple and its subsidiaries are third-party beneficiaries of these Terms for App Store-distributed versions and may enforce these Terms against you as a third-party beneficiary.

Agefully is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, and uninterrupted operation.

We do not warrant that Agefully will meet your needs, produce accurate results, improve your health, prevent aging, change any biomarker, be error-free, be secure, or remain available.

No content in Agefully creates a professional, fiduciary, medical, dietitian, trainer, therapist, or healthcare relationship.

To the maximum extent permitted by law, Agefully and its owners, officers, directors, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, lost profits, lost data, lost goodwill, personal injury, emotional distress, business interruption, substitute services, or damages arising from reliance on Agefully.

To the maximum extent permitted by law, our total liability for all claims relating to Agefully or these Terms will not exceed the greater of the amount you paid to Agefully for the service giving rise to the claim during the three months before the claim arose or 100 USD.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you. In that case, liability is limited to the maximum extent permitted by law.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Agefully and its owners, officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your use of Agefully, your content, your violation of these Terms, your violation of law, or your infringement or misappropriation of third-party rights.

We may change, suspend, discontinue, limit, remove, or add features, content, subscriptions, pricing, AI models, vendors, limits, or access requirements at any time where permitted by law.

We may update these Terms from time to time. The updated version will be posted with a new effective date. Continued use of Agefully after changes become effective means you accept the updated Terms.

You may stop using Agefully at any time. Deleting the app may remove local data but does not automatically cancel subscriptions, delete records held by app stores or providers, or resolve outstanding obligations.

We may suspend or terminate your access immediately if we reasonably believe it is necessary to enforce these Terms, protect the service, comply with law, prevent harm, prevent abuse, or reduce legal risk.

Sections that by their nature should survive termination will survive, including ownership, user content licenses, disclaimers, limitations of liability, indemnity, dispute terms, and payment obligations.

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law rules, except where consumer protection law requires another law to apply.

Before filing a claim, you agree to contact us and try to resolve the dispute informally. If a dispute cannot be resolved informally, the courts located in Toronto, Ontario will have exclusive jurisdiction, except where applicable law gives you the right to bring claims elsewhere.

Any claim must be brought individually and not as a plaintiff or class member in any class, collective, consolidated, or representative action to the maximum extent permitted by law.

These Terms and the Privacy Policy are the entire agreement between you and Agefully regarding the services. If any provision is found unenforceable, the remaining provisions remain in effect and the unenforceable provision will be modified to the minimum extent necessary.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
